The additional sessions judge in Kollam in Kerala sentenced the managing director of Navabharath Hospital, Sasthamcotta in Kollam district to imprisonment till the rising of the court after convicting him for violation of provisions of drugs acts.
The court also sentenced a fine of Rs.1,20,000 (Rupees one lakh, twenty thousand) in addition to detaining the doctor in the courtroom for a full day.
Dr P Kamalasanan, managing director of Navabharath Hospital was held guilty for violations of clauses 18c, 18A and 18 a-vi, of the Drugs & Cosmetics Act 1940. During inspection at his hospital by the drug control officials, it was found that the doctor stocked medicines in his pharmacy without obtaining licence from drugs control department and not complying with the provisions for stocking various drugs, said K J John, additional drugs controller, Kollam.
According to the ADC, in the year 2010, the department had conducted inspection in his hospital and seized substantial quantity of medicines stocked there without valid licence. Subsequently, the drug inspector at Sasthamcotta filed cases of violations of 18c, 18A and 18 a-vi, of the D&C Act against the doctor. Claiming exemption of doctors after referring some clauses in the act, the doctor continued stocking and sale of drugs by running the pharmacy at the hospital. The violation cases were first filed before the judicial first class magistrate court at Sasthamcotta and later shifted to the additional sessions court at Kollam. The verdict came on August 7, this year.
The ADC, further said, Dr Kamalasanan has now applied for licence and it is under consideration.
When contacted Dr Kamalasanan, he said, the Qualified Private Medical Practitioners Association (QPMPA), an association of private hospital managements in Kerala, was supporting him sticking on some exceptional provisions in the D&C Act. But, he said, he will take the licence and does not want to fight with drugs control department further.
